As we all know, one of the benefits as well as the challenges of the human resource profession is the never-ending change to the legal landscape. This WIP topic will review recent cases at both the state and federal level, including Wisconsin's customized interpretation of what counts as sexual harassment and changes in its treatment of arrest and conviction record cases, the potential expansion of retaliation claims, employer liability for the acts of non-employees, a Labor and Industry Review Commission (LIRC) update in the area of disability law, and FLSA issues, including compensating employees for "walking time" under the FLSA, among others.
Attendees will learn about the trend evidenced by recent Wisconsin LIRC decisions to chart a course for Wisconsin different than federal law in areas of sex harassment and disability, LIRC's new direction in the area of conviction record discrimination and how to address it, and pointers in other emerging areas of employment law.
